These Terms and Conditions ("Terms") govern your booking and participation in any trek, trip, expedition or service offered by Trishul Adventures ("we", "us", "our"), operating from Sahid Khudiram Bose Sarani, Pratiraksha Nagar, Birati, Kolkata, West Bengal 700051, India. By making a booking with us, you agree to be bound by these Terms.
1. Booking & Confirmation
- A booking is confirmed only upon receipt of the applicable advance payment and a duly filled registration form.
- Each participant must provide accurate personal details, valid government-issued photo identification, and any required medical declaration.
- We reserve the right to refuse a booking at our discretion, including on medical, safety or behavioural grounds.
- Bookings made within 15 days of the departure date require full payment at the time of booking.
2. Payment Terms
- An advance of 50% of the total trek/trip cost is required to confirm a booking.
- The balance must be paid no later than 15 days before the date of departure.
- For high-altitude expeditions and international treks, full payment may be required up to 30 days in advance.
- All payments must be made through approved channels (bank transfer, UPI or our official payment gateway). We do not accept cash payments at trail-head.
3. Eligibility & Health
- Participants must be at least 18 years of age. Minors (10–17 years) may join only with a parent or legal guardian and prior written approval.
- You must be in good physical and mental health, and capable of meeting the physical demands of the chosen trek/trip.
- You must disclose any pre-existing medical conditions, allergies or medications at the time of booking. Failure to do so may result in the trek being declined and forfeiture of fees.
- We strongly recommend a medical check-up before participating in any high-altitude trek (above 3,000 m).
4. Code of Conduct
By joining a Trishul Adventures trek/trip, you agree to:
- Follow all instructions issued by the trek leader, guide and support staff.
- Respect fellow participants, local communities, the environment and wildlife.
- Refrain from the use of illegal substances; alcohol consumption is strictly prohibited at high altitudes and during active trekking.
- Carry out all non-biodegradable waste — we operate on a strict "leave no trace" principle.
We reserve the right to remove any participant from a trek/trip for misconduct, intoxication, endangering safety, or non-compliance with the leader's instructions. No refund will be provided in such cases.
5. Risk & Liability
- Trekking and adventure activities carry inherent risks including but not limited to altitude sickness, injury, exposure, weather hazards, road accidents and natural calamities. By booking with us, you acknowledge and accept these risks.
- Trishul Adventures, its leaders, staff and partners shall not be held liable for any injury, loss, damage, delay or death arising from circumstances beyond our reasonable control.
- Participation is entirely at your own risk. We strongly recommend obtaining personal travel and medical insurance covering high-altitude trekking before joining any expedition.
6. Itinerary Changes & Force Majeure
- Itineraries are subject to change due to weather, road conditions, permit restrictions, political situations, natural disasters, or any other circumstances beyond our control.
- The trek leader reserves the right to alter, shorten or cancel any portion of the itinerary in the interest of safety. No refunds will be provided for such modifications.
- We shall not be held liable for delays, cancellations or expenses arising from force majeure events.
7. Insurance
Personal travel insurance is mandatory for all high-altitude treks above 4,500 m and strongly recommended for all other treks. The policy should cover medical emergencies, evacuation, trip cancellation and personal accident.
8. Photography & Media
Trishul Adventures may capture photos and videos during the trek for promotional and marketing purposes. By participating, you grant us a non-exclusive licence to use such media. If you do not wish to be featured, please notify the trek leader in writing at the start of the trek.
9. Intellectual Property
All content on this website — including text, photographs, videos, logos and branding — is the property of Trishul Adventures and protected under Indian copyright laws. Reproduction, distribution or use without prior written permission is prohibited.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.
11. Amendments
We reserve the right to amend these Terms at any time. The version published on our website at the time of your booking shall be applicable to that booking.
